REQUEST TO PURSUE EXPULSION AND/OR NEGOTIATIONS TO DO SO, OF HOUSE MEMBERS INVOLVED IN THE PAST AND ONGOING INSURRECTION EFFORTS AND IN “AID AND COMFORT” OF MR. TRUMP

 

Honorable Mr. Minority Leader:

 

Any attorney, knows the Confederate history of  the  answer to solve this is in the Constitution but no one will concentrate on how to get up under the legal weapon it is. 

 

The present state of the Republican party is generally an insurrectionist party and they must be stopped.  The Constitution provides the path to do so and it appears some Republicans may be open to doing so.

 

If people would follow and heed what the US Constitution says at Section 3 of the 14th amendment, these problems can be addressed under our law and ended cleanly.  It is time to expel members of Congress whether by Legislative 2/3 vote or by quo warranto.  First you need to understand Mr Trump as having been "engaged in insurrection" is not eligible for the President again - full stop.  Stop calling him a candidate or front runner. 

 

It appears Section 3 can be used to 

1. Bar an insurrectionist or "aid and comfort" supporter from office (actually 2 in 1) 

2. Remove same above by quo warranto from office by judicial action in a court 

3, Remove same as above by internal legislative or executive action through 

impeachment legislatively or constitutional state executive authority as by a governor 

4. Removal of same as above for failure to act and thus being involved in the "aid and  comfort" of Section 3 as any of same above.

 

On January 19, 2021 a letter brief style article was posted by a respected Law Professor to Lawfare here  The article points out "Under the Supreme Court’s decision in Powell v. McCormack, eligibility requirements permit exclusion by a majority vote, while all other grounds must be addressed through expulsion and a two-thirds vote. ". Which tends to support that the Congress found Trump" guilty" of the incitement to insurrection, but since he had left office the two-thirds vote was irrelevant.  Thus as argued herein Trump was found guilty by Congress of being engaged in insurrection., and is barred from office.  The article also in a goofy way states that the matter does not belong in a court unless the court is needed to find the person was "engaged in insurrection", which is not the case here fot several reasons.  The article goes on to say "Section 3 is different from a disqualification from federal office imposed as a sentence for an impeachment conviction. A disqualification sentence from the Senate is final and not, for all intents and purposes, subject to judicial review. ". Now this refers to the final sentence of Section 3, and even though the article is written to issues of removal from office by the Congress itself of a sitting member, the final sentence is a jurisdictional statement for either removal from OR bar to running for office again. The onlr escape of Section 3 is to return to Congress for relief by 2/3 vote to clear them. Trump has been "sentenced" by the senate as "engaged in insurrection" from the events of January 6, 2021 and Section 3 then self executes to bar Trump from office. Read the article and cases cited therein: however the article makes clear the Congress has a duty to expel members who violate Section 3.

Given what the above article proves and in accord both the January 6th Committee found and what Jack Smith charged in his DC Indictment it is now firmly established, as well as subsequent actions to date that Trump and supporters  are, were and continue to be "engaged in insurrection" and all persons who continue to support and act  to break or usurp laws of the United States are providing both "aid and comfort" to and are themselves "engaged in insurrection" thus forfeiting their office.  If Congress does not do its constitutional duty then application by quo warranto to a Federal Court is justified to Remove them all.  We see now what failure to enforce the law grows to result in.

 Either lead the majority, follow the majority, or get out of the way of the majority, but to usurp or rebel and obstruct the majority in conflict is insurrection as defined in our law at 18 USC 2383 and it causes a forfeiture of office and permanent bar to office under Section 3 of the 14th amendment - full stop. Greene and Gaetz went so far as to try to shutdown the government in obstruction to their oaths and rapid dispatch to doing their jobs..  That letter is pasted below.  The fax system shows it reached three Republicans on the Ethics committee and two Democrats.  If they cannot help IMPROVE laws they have no place in Congress, and by the Constitution, that attempt to destroy laws is insurrection.

 

There is a vocal minority who believe lies told them and they scream loud but they are the minority and we know this because Mr Trump lost by 7 million votes. Where we need to be working is get a voter ballot Constitutional Amendment on the ballot to enact the National Popular Vote Effort Compact into law by ballot initiatives in Florida, Missouri, Ohio, Arizona and Michigan at minimum to bake the National Popular Vote Effort Compact into those Constitutions so it can be enabled possibly in 2024.  Those five states will push the enabling over the hump and Electoral College thefts will not happen again.

Request to recommend expulsion of Matt Gaetz under Section 3 of the 14th amendment

 

Speaker Mccarthy apparently has suggested Gaetz be expelled.  He is correct but not solely for the reasons Gaetz is being investigated for presently. But the end result is Matt Gaetz has in the public record admitted he is an insurrectionist fighting against and to obstruct his oath and the laws of the United States by implying it is a “sin” to work with Democrats who are in effect 50% of the US Government.

Gaetz and Greene - and others who are following Trump's directives are both fraternizing with an enemy of the United States and violating their oaths of office and duty to the oath and Constitutional directives found in Section 3 of the 14th amendment. 

 

Many of the weapons sent Ukraine are on lend-lease, are old stock we were going to retire, surplus or destroy anyway.  Instead we have a chance to get a few bucks out of them one those oil and gas fields under the very area Putin rushed to annex worth billions start pumping and drilling again. 

 

Trump, Gaetz and Elon Musk are enemies of the United States

 

Mr Trump is an enemy of the United States and became one by law on January 6, 2021 sending his supporters to attack the Capitol.  Mr. Musk is also it seems an enemy also. 

 

Gaetz and Greene have unwisely made no secret they are giving "aid and comfort" to Trump doing his bidding in Congress.  Oh no, could it be so – to a Judge ???  Of course, as EVERY insurrectionist is an enemy of the United States by definition of their acts.

 

1. According to 50 USCS § 2204 [Title 50. War and National Defense; Chapter 39. Spoils of War], enemy of the United States means any country, government, group, or person that has been engaged in hostilities, whether or not lawfully authorized, with the United States;

(3) the term "person" means

(A) any natural person;

(B) any corporation, partnership, or other legal entity; and

(C) any organization, association, or group.

 

2.  According to 10 U.S. Code § 948a – Definitions “hostilities” means:

(9)Hostilities.—

The term “hostilities” means any conflict subject to the laws of war.

 

3.  Mr. Trump knows he has a faction of his supporters willing to be in conflict with the United States authority and law enforcement in armed conflict for Mr. Trump’s causes and “dog whistles” directives to them where “laws of war” always applies to especially America’s own citizens but does apply here. But enough information and video is in the public record  as testimonial evidence to show Gaetz and Greene at the root through Trump of the effort to shut down the government trying to usurp and break laws of the United States believing they can do so as legislators when they cannot.  Working with insurrectionist Trump they too have become insurrectionists who have actually legally forfeited their own power to hold office.

 

Aid to Ukraine is an International contract obligation by the Budapest Memorandum and though some disavow that,  the American business interests in Ukraine by energy equipment, contracts and platforms are what is actually being defended by the United States. 

 

Mr Gaetz however has indicated he violating the duty to the Constitution declaring in words and actions that Democrats are and enemy justifying removal of McCarthy for doing his job under the Constitution to prevent a ridiculous insurrectionist led shutdown of the United States government.
